عَنْ أَبِيْ هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ قَالَ: قَالَ رَسُوْلُ الله صَلَّى الله عَلَيْهِ وَسَلَّمَ، في البَحْرِ: هُوَ الطَّهُوْرُ مَاؤُهُ، الْحِلُّ مَيْتَتُهُ أَخْرَجَهُ الأَرْبَعَةُ وَابْنُ أَبِيْ شَيْبَةَ وَاللَّفْظُ لَهُ وَصَحَّحَهُ ابْنُ خُزَيْمَةَ وَالتِّرْمِيْذِيُّ وَرَوَاهُ مَالِكٌ وَالشَّافِعِيُّ وَأَحْمَدُ.

From Abu Hurayrah (r.a) that the Prophet (s.a.w) once said of the sea: "The sea is holy water again purifying, halal carcass." (Mentioned by al-Arba'ah and Ibn Abu Syaibah, while lafadznya according to the history of Ibn Abu Syaibah. Ibn Khuzaimah and Imam al-Tirmizi considered it to be valid. Meaning of Hadith

This hadith is one of the sacred foundations that contains many important laws and methods. In the sea, there are many animals that sometimes die, while the law of the carcass is also unclean. The Prophet (s.a.w) told them that this type of carcass law was different from other carcasses. It can be concluded that this hadith is the answer to the question of a friend who asked in the following context: "O Messenger of Allah, we used to use the sea road and we were only able to bring a little freshwater. When the freshwater we bring is used for stirring, we will be thirsty, can we stir by using seawater?" Then the Prophet (s.a.w) gave them the understanding that the seawater is holy again sanctifying (can be used for purification). The Prophet (s.a.w) added another law that was not asked, even though it should have been asked but not asked because of its hidden legal position. This is because the carcasses of animals in the sea are halal and do not need to be slaughtered anymore.

Fiqh Elements

People who do not know a problem are asked to ask a person of knowledge.

  • It is permissible to use the sea as a means of transportation even though it is not for worship purposes because the questioner is used to using the sea road to catch fish.
  • When you are worried about experiencing thirst, it is permissible not to use drinking water to purify because of the recognition of the Prophet (s.a.w) against the questioner to save drinking water and not to use it for purification.
  • Holy sea water again purifies with understanding can remove hadas and can clean unclean or dirt. Fish do not need to be slaughtered because sharia has legalized the carcass the same as other marine animal fish.
  • Halal eats the carcasses of marine animals that only live in them.
  • It is permissible to answer more of the questions asked to perfect the benefits and to provide knowledge regarding matters that are not asked.

Hadith Narration

The one who narrates this hadith is Abu Hurayrah (r.a), his real name is Abdurrahman ibn Shakhr al-Yamani al-Dausi. He converted to Islam in the 7th year of Hijri and narrated 5,374 hadiths and was among the most narrated companions of hadith. He died in 59 Hijri at the age of 78 and was buried in Medina.
